A-Data Controller:
Albayrak Hazır Beton San. Ve Tic. A.Ş. (“ALBAYRAK”), we take utmost care in protecting personal data. We process the personal data of all individuals, including our customers, staff, visitors, interns, and job/internship applicants, as the data controller, in accordance with the Personal Data Protection Law No. 6698 (“Law No. 6698”), as outlined in detail below.
B-Purposes of Processing Personal Data:
Your personal data may be processed within the scope of the personal data processing conditions specified in Articles 5 and 6 of Law No. 6698;
Ensuring the legal and commercial security of our Company and persons who have a business relationship with our Company, organization and event management, execution of sales and purchasing processes, execution of finance and accounting transactions, execution of internal audit processes, management of environmental protection and waste processes, execution of occupational health and safety activities, fulfillment of the obligation to notify the relevant/authorized public institutions (e.g., Courts, Ministry of Environment and Urbanization, Ministry of Finance, Ministry of Labor and Social Security, Ministry of Internal Affairs, etc.)
Ensuring the execution of our Company's human resources policies, execution of information and physical security processes.
C-Transfer of Your Personal Data
Your data is processed for the purposes listed above, stored securely, and will not be shared with third parties except as required by legal regulations or with your explicit consent.
D-Persons/Organizations to Which Personal Data Can Be Transferred and Purposes of Transfer:
Your personal data may be transferred to authorized public institutions/organizations in accordance with the obligations arising from legal legislation such as the Turkish Commercial Code (TCC), Tax Procedure Law, Social Security Institution, Employment Law, OHS Law, Environmental Management Regulation, to intermediary financial institutions for the purpose of assessing financial risks, to real estate evaluation companies for the execution of mortgage procurement processes, to institutions providing intermediary/agency services in business travels and organization, reward processes, to our business partners, shareholders, affiliated group companies, and to organizations from which we receive support in our business processes, all within the framework of legal bases and your consent.
E- Collection Method and Legal Reason of Personal Data:
Your personal data is collected by our Company through different channels and based on different legal reasons in order to carry out our commercial activities,
in line with the processing purposes stated above, within the personal data processing conditions specified in Articles 5 and 6 of Law No. 6698. As part of executing commercial processes, your data may be collected verbally, in writing, or electronically through written documents/forms such as pre-order forms, contact information forms, occupational health and safety assessment forms, supplier information forms, other commercial details, payment information, valuable documents, candidate application forms, and notifications you provide. This data may be collected through automated or partially automated systems, or as part of a non-automated data recording system. Additionally, your data may be obtained from external sources, including partner institutions, organizations we collaborate with, official institutions, and other third parties.
F- Rights of the Personal Data Owner Listed in Article 11 of Law No. 6698:
The rights of real persons whose personal data is processed pursuant to Article 11 of the KVKK are as follows:
. To learn whether personal data is being processed,
. To request information if personal data has been processed,
. To learn the purpose of processing personal data and whether it is used in accordance with its purpose,
. To know the third parties to whom personal data is transferred, either domestically or abroad,
. To request the correction of your personal data if it is processed incompletely or incorrectly, and to request that third parties to whom your personal data has been transferred be notified of the action taken,
. To request the deletion or destruction of personal data when the reasons for processing no longer exist, even though it has been processed in accordance with Law No. 6698 and other applicable laws, and to request that third parties to whom the personal data has been transferred be notified of the action taken.
. To object to a result that is detrimental to the individual, resulting from the analysis of processed data exclusively through automated systems,
. The right to demand compensation in the event of damages caused by the unlawful processing of personal data.
. If you, as a personal data owner, submit your requests regarding your rights listed above to our Company, the Company will evaluate and finalize the requests from data owners within thirty days at the latest, depending on the nature of the request, within the framework of Article 13 of the KVKK. Responses, whether positive or negative, to requests from data owners may be communicated to them in writing or electronically. While requests from data owners will, as a rule, be resolved free of charge, if responding to the request requires an additional cost, a fee may be charged in amounts determined within the framework of the applicable regulations.
It is important that the personal data we keep about you is accurate and up-to-date, and it is important that you notify our Company when there is a change in your personal data.
You can submit your requests to our Company by filling out the “Data Owner Application Form.” on our website and through the channels specified in the form.
*We may periodically update this Personal Data Protection Information and Disclosure Text. The current version of the text is available on the Albayrak Concrete website, and any updates that may be made to the text can be followed from the Albayrak Concrete website. As a general rule, changes will be posted on the Albayrak Concrete website and will take effect from that date. However, Albayrak Concrete may also notify users of changes through other means it deems appropriate.
